1. Introduction

Welcome to Hostking Nigeria. By accessing or using any service provided through www.hostking.com.ng or our client portal at my.hostking.host, you agree to be bound by these Terms of Service. Please read them carefully before purchasing or using any of our services.

2. Services Provided

Hostking Nigeria provides the following services to Nigerian and international customers:

Shared web hosting (Linux and Windows)
WordPress hosting
Reseller hosting (Linux, cPanel, Windows)
Linux VPS servers
Domain name registration and transfer
Business and enterprise email hosting
SSL certificates
Website design (complimentary one-page setup on qualifying plans)

3. Acceptable Use

You agree to use Hostking services for lawful purposes only and in compliance with all applicable Nigerian and international laws. The following activities are strictly prohibited on our servers and network:

Sending spam or unsolicited bulk email
Hosting phishing websites, malware, or fraudulent content
Conducting advance fee fraud (419) or any other form of online fraud
Hosting or distributing child exploitation material
Interfering with or disrupting other customers' services or our network
Using our services to launch DDoS attacks or any form of network attack
Hosting content that violates Nigerian law, including the Cybercrimes (Prohibition, Prevention, Etc.) Act 2015
Mining cryptocurrency on shared hosting infrastructure
Reselling services in violation of your hosting plan's terms

Hostking reserves the right to suspend or terminate any account found to be in violation of this Acceptable Use Policy, without prior notice and without refund where violations are severe.

4. Account Registration

To use our services, you must register an account through our client portal at my.hostking.host. You agree to:

Provide accurate, current and complete registration information
Keep your account information up to date at all times
Maintain the confidentiality of your account password
Be solely responsible for all activity that occurs under your account
Enable two-factor authentication (2FA) — we strongly recommend this for all accounts
Notify us immediately of any unauthorised use of your account at support@hostking.host

5. Billing, Payment and Pricing

All prices for Nigerian customers are displayed in Nigerian Naira (₦). Payments are processed securely via Flutterwave, which supports Nigerian bank cards (Verve, Mastercard, Visa), bank transfer and USSD. No foreign currency or foreign card is required.

Services are billed on the billing cycle you select at purchase (monthly, annually, etc.)
Your subscription renews automatically at the end of each billing cycle unless you cancel before the renewal date
Renewal invoices are sent to your registered email address before the due date
If payment is not received by the due date, services may be suspended without prior notice
Suspended accounts have a grace period of 14 days before permanent termination and data deletion
Hostking reserves the right to change pricing at any time with reasonable notice to existing customers
Domain name registration fees are non-refundable once the domain has been registered

6. Refund Policy

Hostking offers a 30-day money-back guarantee on all shared web hosting plans. This applies to your first invoice for each new hosting service.

Refund requests must be submitted via a support ticket at my.hostking.host within 30 days of your initial sign-up date
Refunds are evaluated individually and may be issued as a full refund, partial refund, or account credit depending on the circumstances
Domain name registration fees are non-refundable
VPS server plans, SSL certificates and add-on products are not covered by the 30-day money-back guarantee unless stated otherwise
Accounts terminated for violations of these Terms are not eligible for a refund
Refunds are processed back to the original Flutterwave payment method

7. Service Availability and Uptime

Hostking targets 99.9% uptime for all shared hosting services. Scheduled maintenance windows are communicated in advance where possible. Hostking shall not be liable for service interruptions caused by:

Force majeure events including power outages, natural disasters, or government actions
Third-party network or infrastructure failures beyond our control
Actions of the customer or third parties that affect service availability
Scheduled maintenance, notified in advance

8. Data, Backups and Security

Hostking performs daily backups of shared hosting accounts as a courtesy. However, you remain solely responsible for maintaining independent backups of all your website data, databases and email.

Hostking backups are provided for disaster recovery and are not guaranteed to be available at all times
You are responsible for ensuring your website code, plugins and applications are kept up to date and secure
Hostking reserves the right to remove any content from its servers that violates these terms or applicable law
Hostking will cooperate with Nigerian law enforcement authorities as required by Nigerian law, including the Nigerian Communications Commission (NCC) and relevant agencies under the Cybercrimes Act 2015

9. Intellectual Property

All content on the Hostking website including text, graphics, logos and software is the property of Hostking and is protected by applicable intellectual property laws. You may not reproduce or use our content without prior written permission.

You retain full ownership of all content you host on our servers. By hosting content with Hostking, you grant us only the technical rights necessary to provide the service (storage, transmission, backup).

10. Limitation of Liability

To the maximum extent permitted under Nigerian law, Hostking's total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to Hostking in the three months preceding the event giving rise to the claim.

Hostking shall not be liable for any indirect, incidental, consequential, special or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

11. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these terms or your use of Hostking Nigeria's services shall first be referred to informal resolution by contacting us at info@hostking.host. If unresolved, disputes shall be subject to the jurisdiction of the Nigerian courts.

12. Privacy

Your use of Hostking services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We handle your personal data in accordance with the Nigeria Data Protection Act 2023 (NDPA).

13. Termination

Either party may terminate services at any time. You may cancel your account through the client portal at my.hostking.host. Hostking may terminate or suspend your account immediately and without notice if you violate these Terms. Upon termination, your data will be deleted after the applicable grace period.

14. Changes to These Terms

Hostking reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes your acceptance of the updated terms. We will notify active customers of material changes via email.
